AI Terms and Conditions

1. Definitions

In these Terms, the following definitions apply:

• "FinanceIQ AI Products" means any FinanceIQ products, services, or platforms that incorporate AI features and functionality, including but not limited to the AI Writer and any other current or future AI-enabled features offered by FinanceIQ;
• "AI Writer" means the AI-powered feature that assists with generating financial insights and analysis from your report and dashboard data;
• "AI Content" means any text, data, insights, suggestions, or other output generated by FinanceIQ AI features in response to your inputs;
• "AI Services" means any features within FinanceIQ that are powered by, use, or incorporate artificial intelligence, machine learning, or large language models;
• "Prompts" means any inputs, queries, or instructions you or your authorised users provide to FinanceIQ AI features.

2. FinanceIQ AI Licence and Use Rights

2.1 Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable right to use AI Services within FinanceIQ solely for your internal business purposes and in accordance with our documentation.

2.2 AI Services are provided as part of your FinanceIQ subscription. Your use of AI Services is subject to any usage limits or restrictions specified in your plan.

2.3 You acknowledge that FinanceIQ utilises AI technology from third-party providers (including Google Gemini) deployed within our secure environment, and that your use is subject to both these Terms and our responsible AI practices.

3. Acceptable Use of AI Services

3.1 Permitted Use. You may use AI Services within FinanceIQ to:

• Generate insights and analysis from your financial data;
• Create reports, summaries, and documentation based on your data;
• Receive AI-assisted recommendations and suggestions for financial analysis;
• Query your data using natural language through the AI Writer.

3.2 Prohibited Uses. You shall not, and shall ensure your authorised users do not:

• Reverse Engineering: Attempt to discover, extract, or reverse engineer the underlying AI models, algorithms, or system components;
• Data Extraction: Use automated methods to extract data from AI Services except through approved interfaces;
• Model Training: Use FinanceIQ or any AI Content to create, train, fine-tune, or improve any other AI system or model;
• Harmful Content: Use AI Services to generate, process, or distribute content that is illegal, harmful, abusive, discriminatory, infringes third-party rights, or violates applicable laws;
• Misrepresentation: Present AI Content as human-generated or remove indicators that content was AI-generated;
• Excessive Use: Submit requests designed to overload, test limits, or disrupt the AI Services;
• Unauthorised Access: Attempt to access AI features or data beyond your authorised permissions.

4. Your Responsibilities

4.1 Content Accuracy. You acknowledge that AI Services may produce outputs that are inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and verifying all AI Content before use and shall not rely solely on AI Content for critical business decisions.

4.2 Compliance. You shall ensure your use of AI Services complies with all applicable laws and regulations, including data protection, privacy, anti-discrimination, and intellectual property laws.

4.3 Input Quality. You are responsible for the accuracy, quality, and legality of all Prompts and data you provide to AI Services. You represent that you have all necessary rights to submit such content.

4.4 Human Oversight. You shall maintain appropriate human oversight of AI Services, particularly for decisions with significant impacts on your business or stakeholders.

5. Intellectual Property

5.1 Your Content. You retain all rights to your data and Prompts. We claim no ownership rights to your inputs to AI Services.

5.2 AI Content. Subject to your rights in the underlying data, you own all AI Content generated specifically for you. However, you acknowledge that similar outputs may be generated for other users with similar prompts, AI Content may not be unique, and we retain rights to aggregated, anonymous insights derived from usage patterns.

5.3 Feedback. Any feedback you provide about AI Services may be used by us without restriction to improve our products and services.

6. Disclaimers and Limitations

6.1 No Warranty of Accuracy. AI SERVICES ARE PROVIDED "AS IS" AND WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF AI CONTENT. AI SERVICES ARE NOT ERROR-FREE AND MAY GENERATE INCORRECT INFORMATION.

6.2 No Professional Advice. AI Content does not constitute professional advice (legal, financial, accounting, or otherwise). You should consult appropriate professionals for specific advice.

6.3 Third-Party Claims. You are solely responsible for any third-party claims arising from your use of AI Services or AI Content, including claims of intellectual property infringement.

7. Pricing and Usage

7.1 AI Services may be subject to additional fees as specified in your subscription plan. We reserve the right to introduce or adjust fees for AI Services upon notice.

7.2 We monitor AI Services usage and may implement fair use limitations. Excessive usage may result in additional charges or temporary restrictions.

7.3 We may add, modify, or remove AI features. Significant changes will be notified in advance where practicable.

8. Term and Termination

8.1 These AI Terms continue for the duration of your FinanceIQ subscription. Termination of your subscription includes termination of associated AI Services.

8.2 We may suspend or terminate your access to AI Services immediately if you violate these terms or our Acceptable Use Policy.

9. Governing Provisions

9.1 In case of conflict between these AI Terms and other provisions of your agreement with FinanceIQ, these Terms prevail solely regarding AI Services use.

9.2 We may update these Terms to reflect changes in AI technology, regulations, or our service offerings. Material changes will be notified 30 days in advance.
